Licensee’s failure to file appellant brief against board decision, after board appeals, dooms license defense

A Missouri nurse who won an initial judicial appeal of a license revocation lost the next round when her attorney failed to file an appellant's brief in response to the state nursing board's subsequent appeal, in a state Court of Appeals ruling December 22.

Although the board was the appellant of the judicial case, because the appellate court was directly reviewing the board decision, the licensee was required to file an appellant's brief of that decision to the appeals court.
