Court reverses discipline over lack of proof that licensee actions were willful

The Superior Court of Delaware, in a January 26 decision, overturned and remanded a decision by the state's Board of Medical Licensure and Discipline holding a licensee had improperly failed to report his criminal convictions to the board.

The court held, among other things, that the specific laws cited by the hearing officer in the case required that the licensee willfully commit abuse, which the court interpreted to mean that the licensee understood his actions to have been abusive.
