Case against board revived after trial court failed to notice that board had withdrawn preliminary objections

In an unusual case, a trial court judge in Pennsylvania failed to acknowledge two separate withdrawals of preliminary objections made in error by the state's nursing board. As a result, he had in both cases time ruled in favor of the nursing board on the objections and consequently improperly dismissed the case.

The Commonwealth Court of Pennsylvania reversed that dismissal August 10, the court's action being supported by both the trial court and the defendant State Board of Nursing.
